The New Web Based Training (WBT) Series: Preventing Sexual Harassment for Assignees to the USA

International assignees that are used to a less regulated workplace in their native country, sometimes find it difficult to understand the type of behavior that can subject their company, or themselves, to multi-million dollar lawsuits while they are living and working in the United States. The law in the United States does not recognize cultural differences as a defense for inappropriate sexual misconduct. While an off-handed comment, an email cartoon, a joke around the water cooler or even a friendly touch in the workplace may be perfectly innocent on foreign soil, that same phrase or action may cause serious repercussions in this country.

There are basic differences between US and international attitudes toward regulating such behavior in the workplace. These differences are largely found in state and federal employment-related laws implemented in the US over the last 30 years. Most Asian and Latin American countries, for example, did not adopt EEO laws until the mid-1980s or later. Where they have been adopted, most of the countries have not come nearly as close to regulating personal interaction in the work environment like the US has. In addition, cultural as well as historical awareness of the roles, and rights, of women and minorities in the workplace shared by many nations is often confusing because of what is expected when conducting business in the United States.

Global companies need to address both the content and administration of their personnel policies in the international marketplace. Global companies should provide comprehensive discrimination and harassment training for all employees, including specialized training for foreign employees working in the US. Global companies operating in an international arena must be aware of their obligations to themselves and their employees.
